Should the federal “RICO” Act, so long associated with organized crime syndicates such as “La Cosa Nostra,” be used to prosecute local street gangs?   Should a local “clique” of a gang sharing only a name with cliques elsewhere in the country be subject to federal, rather than local, prosecution?  How many members should the gang have, how organized should they be, and what activities should they participate in, in order to come under federal jurisdiction?  States have gang-specific statutes – should they be trumped by federal laws not originally crafted for such situations but offering much higher mandatory sentences?

Ed Rosenthal and Jonathan Simms are working on an appeal in the United States Court of Appeals for the Fourth Circuit in which they are defending a ruling obtained from Judge Leonie M. Brinkema of the U.S. District Court in Alexandria that reduced a claim for attorneys' fees in an employment case by approximately two-thirds.  The opinion is notable because Judge Brinkema squarely rejected the use of the so-called Laffey Matrix -- a scale of pay rates applicable to attorneys of various levels of experience collected in the District of Columbia -- to determine the prevailing hourly rate payable as reasonable attorneys' fees for purposes of the federal Fair Labor Standards Act.  The same legal standard applies to fee awards in federal actions, including civil rights claims, in which a prevailing party may recoup their reasonable attorneys' fees from the other party.   The court also rejected several categories of charges for which reimbursement was sought as not reasonably necessary in the litigation of the underlying case, which was the subject of a compromise settlement negotiated by the RRMDK attorneys.  An article from Virginia Lawyers Weekly describing Judge Brinkema's decision -- which she recently cited as precedent in another fee-setting case -- may be found at:

Rich Rosenthal Manitta Dzubin & Kroeger, LLP celebrate their first anniversary aboard Miss Mallory

ALEXANDRIA, VA – One year ago, Lonnie C. Rich, Edward S. Rosenthal, Lana M. Manitta, Richard F. Dzubin and Shannon L. Kroeger formed Rich, Rosenthal, Manitta, Dzubin and Kroeger, LLP, formed a full-service law firm located in the Torpedo Factory Office Building on the waterfront in Old Town. 

On June 11, the firm celebrated its anniversary with a dock side reception aboard the Miss Mallory followed by a scenic cruise up the Potomac River. Many clients, friends and family members of the firm came out to celebrate the occasion. Among the guest were several local judges as well as Alexandria Mayor Bill Euille and State Senator Patsy Ticer.
